Defection: Governor Ayade Remains Cross River Governor, Defeats PDP - Court Rules

Ayade won on principle of stare decisis. Stare decisis is the doctrine that courts will adhere to precedent in making their decisions.

 
The Federal High Court sitting in Abuja has ruled in favour of Governor Ben Ayade and his deputy after they defected to the All Progressives Congress from the Peoples Democratic Party.
 
According to the court, the duo cannot be removed by the judiciary.
 
Justice Taiwo Taiwo gave the verdict on Thursday.
 
“The point must be made that it is not the duty of the court to make law. If a gap is disclosed, the remedy lies in amending the act”

“This court has no power to declare vacant the seat of the governor and deputy, ” he said.
