Nnamdi Kanu, leader of the Indigenous People of Biafra and his co-accused – David Nwawusi and Benjamin Madubugwu – have accused Justice James Tsoho of unfairness and bias for ruling that prosecution witnesses can testify behind a 'shield', with their identities hidden.
Kanu through his counsel have asked an Abuja Division of the Court of Appeal to order the Chief Judge of the Federal High Court, Justice Ibrahim Auta, to withdraw the case from Justice Tsoho and re-assign it to another judge.
According to him, Justice Tsoho has shown bias in the ruling he delivered on Monday permitting masked prosecution witnesses to testify against him which he calls unlawful, bias and unfair.
He is asking the Court of Appeal to set aside Justice Tsoho’s ruling and transfer the case to another judge of the Federal High Court.
Kanu and his two co-defendants are being prosecuted on six counts of treasonable felony, unlawful possession of firearms and other offences bordering on their agitation for secession of the Republic of Biafra from Nigeria.
