A key source and whistleblower in the case, Clement James, disclosed in an exclusive interview that the prosecution has begun presenting witnesses, with more expected to testify at the next adjourned date.
The s*x-for-marks scandal at Babs Fafunwa Millennium Senior Secondary School has taken a new turn, as two female students have given testimonies in court against the embattled Further Mathematics teacher. Meanwhile, the school’s former principal has filed a N50 million defamation lawsuit, widely viewed as an attempt to intimidate a whistleblower.
A key source and whistleblower in the case, Clement James, disclosed to SaharaReporters in an exclusive interview that the prosecution has begun presenting witnesses, with more expected to testify at the next adjourned date.
“On the r*pe case, two girls have testified and I’m left to testify with one remaining girl,” James said.
He revealed that the court has fixed April 2, 2026, for the continuation of trial, where the final witnesses, including himself and another victim, are expected to give evidence.
“The court has now set April 2 as the date for continuation of trial where myself and the last girl will be testifying,” he added.
According to him, proceedings at the last hearing could not continue due to the absence of the principal’s legal representative.
“I got to court with the girls on that day but the absence of the principal’s lawyer did not let the case continue,” he said.
Providing further details, James noted that while other parties were present in court, the defence counsel for the principal failed to appear and instead sent a letter seeking adjournment.
“The counsel for Gbenga was around, a counsel holding watching brief on behalf of the complainant was also around while the counsel for the Principal was not around and he wrote a letter to the court begging for an adjournment being that he was at another court on that day,” he said.
“The case was adjourned to April 2,” he added.
James disclosed that he appeared at the Lagos High Court earlier this week over the civil suit.
He added that the claimant’s lawyer requested time to file further processes, which the court granted.
“The claimant’ lawyer pleaded to file application for CMC and the court granted it,” he explained.
“The case is now adjourned to May 4 where their lawyer will be submitting his application for CMC.”
The development comes amid an ongoing criminal case involving allegations that the teacher, Mr. Egberongbe Adegbenga Toheeb, s*xually abused at least 11 female students under the guise of offering academic assistance.
SaharaReporters had earlier reported how victims accused the teacher of coercing them into s*xual acts in exchange for marks, with disturbing testimonies detailing manipulation, harassment, and attempted r*pe within school premises and outside locations.
Despite the gravity of the allegations, the school management had been accused of attempting to cover up the scandal and targeting the whistleblower, who first exposed the abuse.
James had previously alleged harassment, intimidation, and unlawful detention by school authorities after he reported the case to relevant agencies, including the Lagos State Ministry of Education and the Domestic and S*xual Violence Agency (DSVA).
Efforts to get fresh comments from the school authorities and legal representatives of the principal were unsuccessful as of the time of filing this report.
The case is expected to resume on April 2, with the testimonies of the remaining witnesses likely to shape the direction of the trial.
