Court Strikes Out Kashamu's Application to Prosecute NDLEA Chairman

The Lagos Federal High Court judge, Justice Ibrahim Buba,yesterday turned down the application filed by Senator Buruji Kashamu to prosecute the chairman of National Drug Law Enforcement Agency (NDLEA), Ahmed Giade over rights infringement.

 
The battle for Senator Buruji Kashamu's extradition to the United States saga is still on going as the accused has moved to take his pound of flesh from the Chairman of National Drug Law Enforcement Agency (NDLEA), Ahmed Giade who he believes has been witch-hunting him.

His request  to prosecute the NDLEA Chairman was filed following due legal procedures through his Lawyer, Ajibola Oluyede but unfortunately for him, the Lagos Federal High Court Judge, Justice Ibrahim Buba on Wednesday, June 23 rejected the application.

Justice Buba declared that the committal proceedings initiated by Kashamu, who the NDLEA has been finding every means possible to extradite to the United States to answer questions on the issue of drug-related charges, had become academic and similar to an application which had already been decided by another judge of the court, Justice Okon Abang.

Justice Abang had earlier restricted the NDLEA from effecting a warrant of arrest for Kashamu thereby nullifying the provisional warrant of arrest secured by the NDLEA against him.

However, in line with judicial proceedings, Justice Buba yesterday stated that the order must be complied with until set aside by a superior court. The judge dismissed a preliminary objection filed by the NDLEA as well. He further asserted that from the processes before him, he was satisfied that the defendants were properly served.
 
In the committal application, Kashamu, through his lawyer, Ajibola Oluyede, said Justice Abang, on January 6, last year, restrained security agencies from arresting Kashamu in respect to allegations contained in a petition dated December 18, 2009.
