Serious questions concerning the integrity of the legal system and respect for the judicial process are raised by the developments surrounding the ongoing cases before the Nigerian Supreme Court. Wike's conduct outside of the courtroom demonstrate the worst disrespect and contempt for the courts at a time when important issues involving the Peoples Democratic Party are still pending before the court under STAY OF EXECUTION.
The definition of a stay of execution is a crucial concept that needs to be understood. All actions related to the contested subject must stop when a judge issues a stay of execution.
Nothing new should be done. No step should be taken that could change the situation on ground until the court gives its final decision. In simple terms, the matter remains alive, but frozen, so that justice is not disrupted or made useless before judgment is delivered.
The conduct of Nyesom Wike, including the formation of structures and the holding of a NEC meeting while related issues remain before the Supreme Court is a big slap on the authority of the court Such actions appear to go against the spirit and purpose of a stay of execution.
Sadly, Justice Joyce Abdulmalik - FHC Abuja and Justice Uche Agomoh - FHC Ibadan, who should know better, are the ones enabling Wike with their alleged corrupt Judgements to spit on the whole of the judiciary.Do these two Justices not know what stay of execution means?
This is why any action taken while such a stay is in place raises serious legal and ethical concerns. Proceeding with steps such as setting up criminal illegal committees or holding major decision making meetings tied to the same dispute can be seen as ignoring the authority of the court. It creates the impression that the judicial process can be bypassed or weakened as Wike has embarrassingly shown against the judiciary.
He is behaving as if he is superior than the Supreme Court. Wike keeps spitting on the judiciary and is single handedly being the number one reason Nigerians have lost confidence in the judiciary, as Justices like Abdulmalik and Agomoh keep rewarding his destruction of the judiciary.
The judiciary must respond firmly by reinforcing clear standards. Judges must uphold discipline within the system and ensure that court orders are respected in both word and action. Where violations occur, appropriate consequences are necessary to protect the authority of the courts, not Justice Abdulmalik rewarding Wike for spitting her orders right back to her face and firming his illegal caretakercommittee.
Respect for procedure is essential to Nigeria's legal system. The basis of justice is undermined when court orders are disregarded. Clarity, firmness, and a renewed dedication to the idea that no one is above the law are necessary for rebuilding confidence.
