Nigerian Living Abroad Sues EFCC Over Wanted Declaration

A Nigerian based abroad, Oluwatosin Adekunle, has taken the EFCC to court over being declared a wanted person.

He wants the court to rule that the action was unlawful, unconstitutional and a breach of his fundamental rights.

In an affidavit dated August 24, 2026, he said the EFCC declared him wanted on August 19 and posted the notice on its website and social media pages without a court order or leave of court.

He wants the court to order the commission to take down the notice and stop publishing his name as a wanted person.

He also wants it stopped from taking any step that would violate his rights to personal liberty, private and family life, freedom of movement and freedom from inhuman and degrading treatment.

On top of that, he is asking for a public apology and 5 million naira in damages.

Adekunle said the matter started with his business partner, Mrs Victoria Chidinma Nwachukwu, who has a case with the EFCC over alleged money laundering and obtaining money under false pretences.

He claimed she registered Oasis Vivacity Global Limited with his home address as the office address and made him a director and signatory to the company account without his knowledge.

He said trouble began after she allegedly owed a customer and could not be found by the EFCC.

He alleged that the commission then began to harass and intimidate him so it could arrest him in her place.

He said there is no complaint or evidence directly linking him to any offence, apart from his alleged role as an agent.

He also claimed his family is afraid because of alleged threats that the EFCC would arrest him or any family member if he could not be found.

Adekunle argued that the EFCC cannot declare anyone wanted on its own without a court order.

He said it is a legal status that needs approval from a court, and that with no arrest warrant issued and no escape from custody, the declaration has no legal basis.

No date has been fixed for the hearing.
