The judge granted the order following an ex-parte motion filed by one Nkwo Augustine Eddiego against the Board of CBN and INEC seeking an order to restrain the defendants.
The board of the Central Bank of Nigeria and the Independent National Electoral Commission (INEC) have been blocked from stopping CBN Governor, Godwin Emefiele from running for the office of the president.
Justice Daniel Maidoh of the Delta State high court, Kwale Division gave the order when he granted an ex-parte motion filed by one Nkwo Augustine Eddiego against the Board of CBN and INEC seeking an order to restrain the defendants.
Eddiego sought “An order restraining the defendants from treating the provision of section 9 of the CBN act 2017 as amended as a bar on the Governor and deputy of CBN from seeking political offices pending the hearing and determination of the motion on notice on the suit which borders on the interpretation of and supremacy of the 1999 constitution. “
The court which has jurisdiction over Agbor Kwale in Delta State held that the application seeking to restrain INEC and CBN from Emefiele’s presidential ambition had merit.
“I find that the said application at this statute has merit pending the hearing and determination of the motion on notice.
“In the circumstances, in-line with order 39 rule 3, this motion is hereby granted. The motion on notice is accordingly adjourned to May 25 for hearing. The applicant is to enter an undertaking if the order sought ought not to have been made,” Justice Maidoh said.
